Privacy Policy & Terms of Service

These Privacy Policy & Terms of Service ("Terms") govern your use of Subconvo, a composable search, ranking, and AI-powered analysis tool for YouTube comments ("the Service"), operated by Awerture d/b/a Subconvo ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What Subconvo Does

Subconvo lets you search, filter, rank, and analyze public YouTube comments using a configurable pipeline: you choose how videos are discovered (by topic, popularity, engagement ratio, and other criteria), how their comments are ranked (by keyword match, semantic similarity, recency, and other criteria), and optionally run AI-powered analysis (sentiment, themes, purchase intent, and similar) across the results.

To do this, the Service retrieves video and comment data from YouTube via the official YouTube Data API, and — for semantic ranking and analysis features — sends comment text to Google's Gemini API for processing. See What Data We Process below for details.

No Affiliation with YouTube or Google

Subconvo is an independent tool that uses YouTube's official Data API. It is not affiliated with, endorsed by, or in any way officially connected to YouTube, LLC or Google LLC. All YouTube and Google trademarks are the property of their respective owners. Use of the Service is at your own discretion and risk, and your use of YouTube data through Subconvo remains subject to YouTube's own Terms of Service.

What Data We Process

Data about you (the account holder):

When you sign in with Google, we receive your name, email address, and profile image. We store this alongside:

  • Your subscription status and tier (free or Pro), and your Stripe customer ID, to determine what you can access.
  • Your daily search usage count, to enforce plan limits.
  • Any custom search "Flows" (discovery/ranking configurations) you choose to save.

Data about other people (YouTube commenters):

When you run a search, the Service retrieves public video metadata and comment content (including commenter display names and comment text) from YouTube on your behalf. This data is:

  • Cached briefly — up to 30 minutes — to avoid redundant calls to YouTube for the same video, after which it expires automatically. This is not a permanent archive.
  • Sent to Google's Gemini API when you use semantic similarity ranking or AI-powered analysis features, so that comment text can be embedded or summarized. Google's own terms govern how they handle data sent to their API; we do not control Google's retention or processing of that data.
  • Not otherwise stored, sold, or used by us for any purpose beyond generating your search results.

We process this third-party data on the basis of our legitimate interest in providing the Service you've requested, balanced against the fact that the underlying comments are already public on YouTube. We do not use it to build profiles of commenters, to contact them, or for any purpose beyond the search and analysis you initiate.

How We Share Your Information

We use the following service providers to operate Subconvo:

  • Google — for sign-in (OAuth), YouTube data retrieval, and Gemini API processing (semantic ranking and analysis features).
  • Stripe — for payment processing. We do not store your payment card details; Stripe handles this directly and is subject to their own terms of service.
  • Upstash — for short-term (30-minute) caching of comment and video data, to reduce redundant YouTube API calls.
  • Vercel — for hosting the Service.
  • Google Analytics — for basic usage analytics (page views, navigation patterns). This uses cookies. To opt out of Google Analytics tracking across all websites, visit the Google Analytics Opt-Out Browser Add-On download page.

We do not sell your personal data, or the data of YouTube commenters processed through the Service, to anyone.

Our Legal Basis for Processing

Our legal grounds for processing personal data are:

  • Processing necessary for the performance of our contract with you (providing the Service you've signed up for).
  • Our legitimate interests in operating, securing, and improving the Service, including the processing of publicly available YouTube comment data described above.
  • Processing necessary to comply with our legal obligations.
  • Processing to which you have given your consent (e.g., analytics cookies, where required by your jurisdiction).

What Are Your Rights?

If you are located in the European Economic Area, the UK, or a jurisdiction with similar protections, you have rights under the GDPR (or equivalent law), including the right to:

  • Access the personal data we hold about you.
  • Have your personal data corrected or deleted, where the conditions for deletion are met.
  • Object to our processing of your personal data.
  • Receive your data in a structured, commonly used, machine-readable format (data portability).
  • Lodge a complaint with a data protection authority, such as the Danish Data Protection Agency (Datatilsynet).

If you are located in California, similar rights apply to you under the California Consumer Privacy Act (CCPA).

Storing of Your Data

We store your account data for as long as you maintain an account with us. If you delete your account, we will delete your personal data within 30 days, except where we are required to retain it for legal, tax, or dispute-resolution purposes.

Cached YouTube comment and video data is retained for a maximum of 30 minutes and is not archived beyond that window.

Payment & Subscriptions

Subconvo offers the following plans:

Payment is processed securely via Stripe on a recurring basis (monthly or annual, depending on your selected plan). We do not store your payment card details.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation stops future billing; you will retain Pro access through the end of your current billing period.

Refunds. We do not offer refunds for time already paid on a billing period, including if you cancel partway through one.

If you are located in the European Economic Area, you have a 14-day right to withdraw from your initial subscription purchase under the EU Consumer Rights Directive. To exercise this right, contact us at hello@awerture.com within 14 days of your first subscription payment, and we will refund that payment in full. This right applies to your initial purchase only and does not extend to subsequent renewal payments.

Your Responsibilities

By using the Service, you agree that you will:

  • Use the Service only for lawful purposes.
  • Comply with YouTube's own Terms of Service when accessing YouTube data through Subconvo.
  • Not use the Service to harass, dox, or otherwise target individual YouTube commenters based on data surfaced through the Service.
  • Not attempt to use the Service to circumvent YouTube API quota limits, scrape data outside the Service's intended use, or resell access to data obtained through the Service.

No Warranty

The Service is provided "as is" and "as available" without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or available at any given time. YouTube and Google may change their platforms or APIs at any time in ways that affect the functioning of this tool, and we cannot guarantee continued compatibility.

Limitation of Liability

To the fullest extent permitted by law, Awerture d/b/a Subconvo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Availability and Changes

We reserve the right to modify, suspend, or discontinue the Service at any time. We may also update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. The date at the top of this page reflects when the Terms were last updated.

Governing Law

These Terms are governed by the laws of Denmark. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the Danish courts.
